Terms and Condition

1. Purpose

The purpose of these Terms of Service is to stipulate the rights, duties, responsibilities, and other requirements of the EDGC (hereinafter referred to as "Company") and service users (hereinafter referred to as "Member") for the use of the Uriwell service (hereinafter referred to as "Service") provided through websites and mobile devices.

 

2. Definition of Terms

The definitions of terms used in these Terms of Service shall be as stipulated in the relevant laws, regulations, and service-specific policies, except as stipulated in article 1. Those not stipulated herein shall be in accordance with general business custom.

 

3. Effect and Change of Terms

  1. The Company shall post the contents of these Terms of Service, the name of the company, representative, the address of the company location, telephone number, fax number, e-mail address, business registration number, telecommunications sales business report number, and the person in charge of personal information management within the Service or in other similar ways so that members can easily recognize them. The contents of the Terms of Service should be available to Members through a screen.

The use contract is concluded when a person who intends to become a Member (hereinafter referred to as the "Applicant") agrees to the contents of these Terms of Service and applies to use the service then the Company approves the application. In principle, the Company shall approve the application of the Applicant. However, the Company may refuse to approve an application that falls under any of the following subparagraphs.
       
    1. The contents of the application are falsely stated or failed to meet the application requirements.
    2. Using the Service through an unusual or circumvented method in a country where the Company has not provided the service.
    3. Applying for the purpose of impairing the safety and order of society or public morals and customs.
    4. Intend to use the Service for fraudulent purposes.
    5. Deemed inappropriate to approve for any other reason under each of the subparagraphs.

  5. The Company may revise these Terms of Service with a reasonable reason within the scope that does not violate the relevant laws and regulations. When the Company revises the Terms of Service, it shall specify the effective date, revision details, and reasons for revision, and notify the Member by posting it in the manner of Article 1 at least 7 days before the effective date. However, if the revised content is unfavorable to the member or is a significant change, it shall be notified in the same manner as these Article at least 30 days before the effective date and notified to the member in the manner of Article 5.

  7. When the Company revises the Terms of Service, it shall confirm after the notification whether the Member agrees to the application of the revision. Company makes an announcement or notice under these subparagraph 4, it shall also make an announcement or notice stating that if the Member does not express his/her consent or refusal to the revised Terms, he/she may be deemed to have consented to the revised Terms. If the Member does not express his/her refusal by the effective date of the Terms, he/she may be deemed to have consented to the revised Terms. If the Member does not agree to the revised Terms, Company or the Member may terminate the use contract. Company shall take measures to enable the Member to inquire and respond to the Company and the contents of these Terms of Service.

The Company may revise these Terms of Service to the extent that they do not violate relevant laws, such as the Act on Consumer Protection in Electronic Commerce, Act on Regulation of Terms and Conditions, Act on Promotion of Information and Communications Network Utilization and Information Protection, and Content Industry Promotion Act.
 

4. Non-Terms and Conditions

Matters not provided for in these Terms of Service and the interpretation shall be governed by the Act on Consumer Protection in Electronic Commerce, the Act on Regulation of Terms and Conditions, the Guidelines for Consumer Protection in Electronic Commerce, etc. set by the Fair Trade Commission, and related laws or practices.

 

5. Notification to Members

  1. When the Company makes notifications to the Member, it may do so by e-mail address or SMS registered by the Member.
  2. The Company may substitute individual notifications by posting them on the website or mobile pop-up screen if it is difficult to notify due to an unspecified number of members or the member's contact information is not listed or changed.
 

6. Conclusion of Use Contract and Membership

  1. A person who intends to register as a Member and use the Service shall apply for membership by filling in the membership information on the registration form prescribed by the Company and expressing his/her intention to 'agree' to terms and conditions.
  2. Members can use the Services from the moment they become a member (However, some services may start from a specified date).
  3. Members can use the Services by downloading and installing a dedicated application (or program) on the website or mobile device. Members who wish to register as a Member and use the website or mobile device dedicated application shall provide the necessary information requested by the Company.
  4. In order to register as a Member, the Member shall enter an account, password, and other matters deemed necessary by the Company in accordance with the form prescribed by the Company after agreeing to terms and conditions, all other agreements related to personal information, and other service-related agreements if necessary.
  5. Members are obligated to provide the information required to use the service. If changes to the registration contents are required, Members are obligated to modify it in accordance with the procedures established by the Company. The Company shall not be liable for any problems due to not changing the information (including problems arising from the Company's inability to notify the Member).
  6. All Members must provide their own information to use the Service. Members who do not accurately register their own information, such as stealing other people's information or registering false information, may be subject to disadvantages such as termination under these Terms of Service, and may be punished in accordance with relevant laws and regulations. In addition, the Company may verify that the member's information is valid.
  7. Members are responsible for the management of their member account and password. The Member is responsible for any damage to the use of the Service or unauthorized use by a third party caused by negligent management, and the Company is not responsible for it.
 

7. Personal Information Protection

  1. The Company shall endeavor to protect the personal information of members in accordance with the relevant laws and regulations, such as Act on Promotion of Information and Communications Network Utilization and Information Protection, and the  Personal Information Protection Act.
  2. The Company shall not reveal or distribute the personal information of the Member to a third party without the consent of the Member, except in the case of due process in accordance with the provisions of the law.
    • - When requested by a related organization for the purpose of investigation under the relevant laws and regulations.
    • - When requested by the competent authority.
  3. Details of the Company's personal information protection shall be governed by the relevant laws and regulations and the "Privacy Policy".
 

8. Deletion of Personal Data

Delete an app or program from the device on which the Service is installed, the data stored on the device will be deleted, but the data stored on the server may not be deleted. To delete data stored on the server, Member must log in and cancel the membership. However, in this case, existing data cannot be restored even if re-register.

 

9. Obligations of Company

  1. The Company shall promptly handle complaints from Member regarding the Service, and if prompt handling is difficult, the Company shall notify the reason and the handling schedule.
  2. In order to provide continuous and stable services, the Company shall repair or restore related facilities and software without delay unless there are unavoidable reasons. However, in the event of a natural disaster, emergency, or other unavoidable circumstances, the Company may suspend or permanently stop the Service.
  3. If damage is caused to the member due to the Service, the Company shall bear the responsibility only if such damage is caused by the reason attributable to the Company.
 

10. Obligations of Member

Member shall not engage in the following acts.

  1. Provide false information when applying or changing for the use of Service, or steal or illegally use other Member’s accounts and passwords.
  2. Reproduce, store, distribute, or sell information obtained by the Services without the prior consent of the Company.
  3. Damaging or giving disadvantage the honor of others, pretending to be others, and falsely stating relationships with others.
  4. Posting obscene material on message boards, etc. or connecting (linking) to obscene sites.
  5. Infringe on the Company's copyrights, copyrights of third parties, and other rights.
  6. Disseminating information, sentences, shapes, or voices, etc. that violate public order and morals.
  7. Registering or distributing computer virus-infected materials that cause malfunction of facilities related to the Service or destruction and confusion of information.
  8. Intentionally interfere with the operation of the Service, transmit information that may interfere with the stable operation of the Service, or transmit advertising spam information against the recipient's express intention to refuse to receive.
  9. Transmit or post information that is prohibited from being transmitted or posted by applicable laws and regulations.
  10. Collect, store, or disclose the personal information of another Member without due process.
  11. Distributing false information for the purpose of obtaining property benefits for oneself or others or causing damage to others.
  12. Promoting or soliciting gambling, or distributing information that is intended to facilitate prostitution or pornography.
  13. Posting or e-mailing materials that contain software viruses or any other computer code, files, or programs designed to interrupt or destroy the normal operation of any computer software, hardware, or telecommunications equipment.
  14. Interfere with another person's normal life by continuously sending speech, sound, writing, images, or video that causes shame, disgust, or fear.
  15. Engage in other illegal or unfair behavior, such as harassing other Member, including stalking.
  16. Acts that violate other relevant laws or are contrary to public order and good morals.
 

11. Indemnification of the Company

  1. If the Company or a Member causes damage to the other party in violation of these Terms, it shall be liable to compensate for the damage. However, this shall not apply if there is no intention or negligence. The compensation for damages under this Article shall be limited to ordinary damages. In the case of special damages, the parties agree not to compensate for damages even if the Company or the Member has foreseen or could have foreseen the occurrence of such damages. In addition, the Member agrees to limit the scope of the Company's compensation for damages to the amount of the Member's usage rights.
  2. The Company shall not be liable for any civil or criminal damages incurred by the free Services that the Member use.
  3. The Member confirms that the Company does not expressly or implicitly warrant that the Service is free from defects in fact or law (including defects, errors and bugs related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc. and infringement of rights), and that the Company is not obligated to eliminate such defects and provide the Service to the Member, and does not raise any objection to this.
 

12. Resolution of Disputes

These Terms of Service or the Service shall be governed by and implemented in accordance with the laws of the Republic of Korea. If a lawsuit is filed for a dispute arising between the Company and the Member in due to the use of the Service, it may be filed in a court of competent jurisdiction under the Civil Procedure Act.
